General terms and conditions
Version 1-11-2026 · These terms apply to every use of BarMaat by a club, including during a trial period. The Dutch version prevails.
1. Definitions
- We: BarMaat, [adres], the provider of BarMaat.
- The club: the club, foundation or organisation using BarMaat, represented by its manager(s).
- The service: BarMaat, an online till and tab system with stock, purchasing, revenue and access management, used through the browser.
- Users: managers, bar staff and other people who have access through the club.
2. Applicability
These terms apply to every request, trial period and subscription. The club's own terms do not apply unless agreed in writing. The data processing agreement also applies to the processing of personal data.
3. Trial period
- A club can request a free trial period of up to 2 months. We review every request and may reject a request without giving reasons.
- The trial is free and without obligation. It ends automatically at the end of the period, unless the club takes out a subscription.
- If there is no subscription afterwards, we may restrict access. The club can still export its data for 30 days; after that we delete it.
4. Subscription and prices
- After the trial, the club uses BarMaat with a subscription at a fixed amount per month, quarter or year, as agreed with the club and stated on the invoice. There are no per-transaction fees.
- The subscription runs per period and is renewed tacitly for the same period each time.
- We may adjust prices once a year and will announce this at least 30 days in advance. If the club does not agree with an increase, it may cancel as of the date it takes effect.
5. Payment
- We invoice in advance per period. The payment term is 14 days after the invoice date.
- If the club does not pay on time, we send reminders. If payment still does not follow, we may suspend access after a final warning until payment is made. The data is kept during that time.
- We initially charge no extra costs for late payment. If payment is more than 60 days late, we may charge statutory interest and reasonable collection costs.
6. Cancellation and termination
- The club can cancel the subscription at any time as of the end of the current period, by email to [e-mail]. A period already paid is not refunded.
- We may terminate the subscription with 3 months' notice, or immediately if the club seriously breaches these terms.
- After termination the club can still export its data for 30 days (Backup → Download export). After that we delete it, except what we are required to keep by law (such as invoices). Copies in backups disappear according to the retention of those backups.
7. Use of the service
- The club decides who gets access and is responsible for what its users do with BarMaat. Login details are personal.
- BarMaat may not be used for anything unlawful, to disrupt the service or to gain access to other clubs' data.
- The club remains the owner of its own data. We only use it to provide the service, as described in the data processing agreement.
- BarMaat records sales but is not a certified till system for tax purposes. The club remains responsible for its own accounts and for what the tax authorities require.
8. Availability and maintenance
- We do our best to keep BarMaat available at all times, but cannot guarantee uninterrupted availability. If the internet connection at the bar drops briefly, BarMaat keeps orders on the device and sends them later.
- We schedule maintenance outside busy hours (evenings and weekends) as much as possible and announce major maintenance in advance.
- We may improve and change the service. If an important feature is removed, we will announce it in advance.
9. Backups
We regularly back up the whole platform in order to restore the service. In addition, the club can set up its own backups to its own storage or by email. We recommend doing so, so that the club always has its own copy of its data.
10. Liability
- Our liability is limited to direct damage and to at most the amount the club paid us in the 12 months before the damage. We are not liable during a free trial period.
- We are not liable for indirect damage, such as lost revenue, cash differences or loss of data that the club could have restored from its own backup.
- These limitations do not apply in case of intent or gross negligence on our part.
- A club reports damage as soon as possible, and at the latest within 3 months of discovering it.
11. Force majeure
We are not liable if we cannot meet our obligations due to force majeure, such as outages at hosting or internet providers, power failures, attacks on the servers or government measures.
12. Changes
We may change these terms. We announce changes at least 30 days before they take effect, by email or in the app. If the club does not agree with a change to its disadvantage, it may cancel as of the date it takes effect.
13. Law and disputes
These terms and all agreements with us are governed by Dutch law. We first try to resolve a dispute together. If that fails, the competent court in the district where we are established has jurisdiction.
